TERMS OF SERVICE & END USER LICENSE AGREEMENT (EULA)

Welcome to My Sewing Patterns. Please read these Terms of Service ("Terms", "Agreement") carefully before using the My Sewing Patterns mobile application, web visualization modules, and related software services (the "App" or "Services"), operated by Toile Designs LLC ("Toile Designs," "we," "us," or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, access, or use the App.

1. Eligibility & User Accounts

• Age Requirement: You must be at least 13 years of age to use the App. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that you have reviewed these Terms with your parent or legal guardian and have received their permission to use the App.
• Account Security: You are responsible for safeguarding your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
• Account Termination & Data Deletion: You may delete your account and all associated user data at any time directly in the App settings under Account > Delete Account or by emailing info@mysewingpatterns.com. We reserve the right to suspend or terminate accounts that violate these Terms.

2. Limited License & Intellectual Property Rights

• Grant of License: Subject to these Terms, Toile Designs grants you a personal, non-exclusive, non-transferable, revocable license to download and use the App on mobile devices owned or controlled by you solely for personal, non-commercial creative visualization.
• App Ownership: All rights, title, and interest in and to the App software, code repositories, user interfaces, design architecture, computer vision algorithms, scale-calibration tools, logos, and trademarks ("My Sewing Patterns", "Toile Designs") remain the exclusive property of Toile Designs LLC.
• Pattern Makers' Copyrights: Sewing pattern designs, silhouettes, line art, technical schematics, and sizing specifications displayed within the App belong exclusively to their respective third-party independent pattern makers, commercial publishers, or brand partners ("Vendors"). Nothing in these Terms grants you any ownership rights, copyright transfer, or commercial reproduction licenses to any sewing pattern or schematic.

3. AI Visual Previews, Scale Calibration & User Content

• User Content License: When you upload or capture photos of physical fabrics or swatches ("User Content"), you retain full ownership of your original photos. You grant Toile Designs a worldwide, royalty-free, non-exclusive, limited license to process, resize, adapt, and render your uploaded images within the App solely to provide visualization features and display them in your personal Design Studio.
• Technical Drape & Scale Calibration Disclaimer: The App utilizes artificial intelligence, computer vision, and scale-calibration algorithms to drape fabric images onto pattern silhouettes. All visual renders, pattern repeat previews, and scale simulations produced by the App are digital approximations intended solely for creative guidance and inspiration. Actual finished garments will vary based on:
  • Physical textile properties (including fabric grainline, weave tension, stretch percentage, hand, weight, and bias drape);
  • Display color rendering variations across different mobile or desktop screens;
  • Pattern size grading, ease allowances, adjustments, and individual sewing construction techniques.
• Metric & Measurement Tooling: Fabric repeat calculations, yardage/meter estimates, and scale-calibration measurements are provided as reference aids only. Users remain responsible for verifying physical pattern envelope yardage requirements and fabric dimensions before cutting.
• Community Showcase: If you choose to share rendered designs to the public community feeds within the App, you grant other users the right to view your visual combinations. You can set your Design Studio to private at any time in your Account Settings.

4. External Links, Redirects & Third-Party Vendors

• Outbound Discovery Model: The App features sewing patterns and acts as a digital discovery and visualization portal. When you choose to purchase a pattern or third-party fabric, the App may redirect you via an outbound link directly to the Vendor’s official website.
• No Retail Liability for External Purchases: Toile Designs LLC does not sell, fulfill, or store digital pattern PDF files on behalf of third-party vendors, nor do we process payment transactions for external storefronts unless explicitly stated. Your purchase, licensing, and download of any third-party pattern or textile are subject solely to that Vendor's terms, conditions, and privacy policies. We are not responsible or liable for external transaction disputes, pattern drafting errors, file corruption, or vendor customer service.
• Direct Supplies & Fabric Purchases: Where the App enables direct retail checkout for physical fabrics, notions, or supplies sold directly by Toile Designs LLC, sales are governed by our standard checkout, return, and shipping policies presented at purchase.

5. Prohibited Conduct

You agree not to:

• Decompile, reverse engineer, disassemble, or attempt to extract the source code, rendering engine, or scale-calibration algorithms of the App.
• Use the App to upload offensive, infringing, defamatory, unlawful, or harmful image content.
• Attempt to bypass security measures, scrape pattern vector paths or line art, or disrupt the App's hosting and data infrastructure.
• Impersonate any person or entity, or misrepresent your affiliation with a pattern brand, commercial publisher, or textile supplier.

6. Disclaimers & Limitation of Liability

• "AS IS" Basis: The App and Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, or non-infringement.
• Limitation of Liability: To the maximum extent permitted by applicable law, Toile Designs LLC, its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of, or inability to use, the App or any third-party patterns/textiles purchased via external links.

7. Jurisdiction-Specific Statutory Provisions

A. United States & General

These Terms are governed by and construed in accordance with the laws of the State of Colorado, USA, without regard to conflict of law principles. Subject to mandatory local consumer protection statutes, any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in Pitkin County, Colorado.

B. Australia (Australian Consumer Law & Privacy Act 1988)

• Australian Consumer Law (ACL): Our Services come with statutory guarantees that cannot be excluded under Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the ACL that cannot be lawfully excluded. If our services fail to meet a statutory consumer guarantee, your rights are determined strictly in accordance with the ACL.
• Australian Privacy Principles (APPs): If you access the App from Australia, your personal data and uploaded imagery are collected, held, and processed in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. User-uploaded fabric photos are processed solely to deliver in-app rendering features and are not sold to third parties. Data transferred to secure cloud infrastructure outside Australia is handled under industry-standard encryption and security protocols.
• Pricing & GST: Any in-app direct purchases, fees, or pricing displayed to Australian consumers are stated in Australian Dollars (AUD) and are inclusive of Australian Goods and Services Tax (GST) where applicable.

C. New Zealand (Consumer Guarantees Act 1993 & Privacy Act 2020)

• Consumer Guarantees Act (CGA): If you are acquiring our Services for personal, domestic, or household use in New Zealand, the guarantees under the Consumer Guarantees Act 1993 apply, and nothing in these Terms limits your statutory rights under the CGA. (If you use the Services for business purposes, you agree that the provisions of the CGA do not apply).
• Fair Trading Act 1986: Nothing in this Agreement affects your statutory rights under the Fair Trading Act 1986. Visualizations, repeat dimensions, and scale previews are representations provided for creative visualization purposes as described in Section 3.
• Privacy Act 2020: Personal information collected from New Zealand users is handled in compliance with the Information Privacy Principles (IPPs) under the Privacy Act 2020, including safeguards governing cross-border information disclosures and mandatory breach notifications.
• Pricing & GST: All direct sales, fees, or retail items displayed to New Zealand users are stated in New Zealand Dollars (NZD) and are inclusive of New Zealand Goods and Services Tax (GST) where applicable.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this document and providing an in-app notice where appropriate. Continued use of the App following the posting of revised Terms constitutes your acceptance of the updates.
